Reality TV star’s split could lead to child custody battle

Reality TV fans in Arizona may have heard that Kourtney Kardashian and Scott Disick have parted ways. The long-time couple confirmed their breakup on July 6.

The breakup is said to be related to Disick’s history of drug and alcohol abuse. He was recently seen partying in France with an ex-girlfriend after completing a stint in rehab. It is not yet known what the breakup will mean for the couple’s three young children, but family law professionals said Disick’s problems with substance abuse will not automatically keep him from gaining custody.

According to experts, family courts highly value parent-child relationships and will seek to preserve those bonds whenever possible. To that end, judges will often attempt to work with parents who have a history of substance abuse, joblessness, mental health issues or even spousal abuse. However, that does not mean Disick will have an easy time gaining custody, particularly if Kardashian puts up a fight. Since he is fresh out of rehab, he may have to meet conditions like mandatory drug testing and supervised visits in order to see his children.

The primary goal of family courts in custody and visitation cases is to act in the best interests of the children involved, and that is normally deemed to be a relationship with both parents. That means Disick could be granted some sort of child custody if he demonstrates that he is working to stay clean.
